Town staff told the board the applicant had submitted the town application and that background checks and the other required documents were on file; “we have received all the necessary information to proceed, and we have, at this point, no issue making the recommendation for the board to approve the permit,” a town staff member said. Staff also said the ABC license from the state agency was likely to arrive that evening or the next morning.
Board members pressed staff on whether approval should be conditioned on written confirmation that the state ABC license arrived. One committee member asked whether the board could “grant the permit conditioned upon written confirmation from the state that the ABC licensure is received.” Town staff said a condition was possible but noted it was not the typical recommendation given staff’s confidence in the completeness of the application. “We typically will wait to discern what the outcome of that is prior to it being presented to the beer board,” staff said, but added that the current file included background checks and other requisite documents.
Counsel for the applicant, Rob Pinson of Adams and Reese, and Legends representatives told the board the company operates amphitheaters nationwide and expected state licensure soon. Pinson said staff had been in contact with ABC officials and that “they will get an ABC license,” and the company said it would use existing catering licenses to serve liquor and wine if necessary while awaiting any delayed ABC action; applicants and staff clarified that the town’s catering license does not cover beer sales.
Board members also asked about enforcement and traffic‑management stipulations tied to past approvals at the site. Town staff said roadway improvements required by rezoning and the site plan had been completed and that the town has administrative tools to address any operational problems, rather than attaching separate permit stipulations. The Legends representative said the sale to the new owners closed roughly April 20–21 and described operational safeguards including staff TABC cards, ID checks and a two‑drink limit per transaction.
After discussion the board voted 3–0 to approve the Legends on‑premises beer permit; two members were absent. The board approved the consent agenda earlier in the meeting and adjourned after the permit vote. Town staff said it would send confirmation of ABC licensure to the board when it is received and will handle any operational issues administratively.
