Board approves two conditional-use permits for businesses at 1555 Merritt Street

The Board of Adjustment & Appeals voted April 9 to approve two conditional-use permits for businesses at 1555 Merritt Street, resolving applications by TK Marine and Brum Repair Incorporated following a February revocation of a prior sitewide permit.
Staff member Kirschke told the board that TK Marine’s application requests permission to store docks, lifts, boats and snow-removal equipment in a roughly 60-by-120-foot leased area of the 22.86-acre site and recommended adoption of Resolution PC2026-009 to approve the exterior-storage CUP. Kirschke said the site had previously been covered by a single exterior-storage CUP that was revoked on Feb. 5 because one tenant violated the permit conditions; the property owner appealed and the City Council upheld the BOAA’s revocation. "TK Marine was previously part of an overall exterior storage CUP for the site that was revoked on February 5 due to one problem tenant," Kirschke said.
Commissioners asked how tenant-specific permits would differ from the former sitewide CUP. Kirschke said the city now expects each tenant to seek a separate CUP so that a violation by one tenant will not result in revoking the entire site’s authorization. He also addressed an aerial image showing boats outside the applicant’s proposed storage area, saying the previous tenant is being evicted and "everything that they should have should be within that red box area going forward." No members of the public spoke for or against the TK Marine application during the hearing.
After the public hearing was closed, a commissioner moved to adopt Resolution PC2026-009 and a unanimous roll-call vote approved the measure.
Later the board opened a separate public hearing for Brum Repair Incorporated, which applied for a CUP permitting vehicle repair and exterior storage at the same 1555 Merritt Street site. Kirschke said Brum Repair provides fleet maintenance for local commercial customers and that site inspections found the business’s leased space "neat and orderly." The staff recommendation was to adopt Resolution PC2026-010 to permit vehicle repair operations, short-term vehicle storage awaiting service and storage of completed vehicles.
Commissioners asked whether the broken-down vehicles that contributed to the earlier CUP revocation had been removed; Kirschke said the tenants responsible were in the eviction process and that personal-property items would be towed after final court action, and that the tenants indicated they planned to vacate the property the next day. The public hearing was closed and the board adopted Resolution PC2026-010 on a unanimous roll-call vote.
Both approvals follow the BOAA’s earlier enforcement action: staff reported the prior revocations (the towing company, the property and an auto-repair business) remain upheld. The BOAA adjourned and will reconvene May 7 at 7:00 p.m.
What’s next: The adopted resolutions implement tenant-level CUPs for exterior storage and vehicle repair at 1555 Merritt Street; staff will monitor compliance and the eviction process for the tenant whose conduct prompted the earlier revocation.
