"I'm speaking to you today as a friend of the Friends of the Equestrian Bridge about the first item on closed session," she said. "On April 16, a month later, the developer formally withdrew his application and the next day after withdrawal, the city's attorney submitted an objection to the court decision arguing that because the project was withdrawn, the judgment in favor of us should be dismissed as moot." She asked the council to "recognize the court's decision... and oppose efforts to erase the decision from the records."
Gabletti told the council that the case began after the city approved the 40-unit project in 2024 under provisions of SB 35 and that the court's decision provides guidance about how state housing laws interact with local objective design standards. "We believe this was the wrong project in the wrong place," she said, and argued the court's ruling offers predictability for other cities reviewing state-mandated housing applications adjacent to industrial uses.
The city attorney, speaking earlier in the meeting, announced the council would meet in closed session at 4:00 p.m. to discuss five items, including "Friends of the Equestrian Bridge versus City of Burbank concerning the housing project at 910 South Mariposa," other existing litigation matters, a conference concerning a proposed lease with the Burbank Historic Society, and anticipated litigation under Government Code section 54956.9(d)(4). The closed session was announced on the record; no deliberations from closed session were disclosed during the public portion of the meeting.
The mayor closed general public comment and recessed into closed session; the council said the regular session would begin at 6:00 p.m.
