Kirk (staff) summarized the requested changes and told the board staff had been working with the applicant on updates.
Attorney Gordon, representing the applicant, described site constraints and the rationale for the change: he said the catchment area was consolidated to a single plant, that surrounding property owners have not committed to future development, and that the proposed plant location is intended to be site-specific unless a regional relocation occurs. "In our view, the need for this MOU to have an expansion would ultimately require the South and the East to relocate it, so there's no pressing need to have this plant expand beyond the 15 acres it would ultimately serve," Gordon told the board.
Board members debated whether removing the one-acre requirement would create an unwanted precedent and recalled that the original MOU language required one acre to support expansion of on-site plants up to 100,000 gallons. With the motion to recommend approval on the floor, Attorney Gordon asked for a deferral to refine the request with the town attorney and staff. The initial motion and second were withdrawn, and Chair (the presiding board member) then moved to defer the item to the board's next meeting; the motion was seconded and the board voted in favor.
The board's action was a procedural deferral; no change to the MOU was approved and staff said they will work with the applicant to bring revised language back at the next meeting.
