Council approves rezoning for small block after applicant argues access and compatibility

Orderville — After a public hearing and discussion, the town council voted to approve a zoning change that reclassifies several small parcels from single-family residential to commercial.

Terry (speaker 15), the property owner, explained the request is intended to secure legal recorded access for the hardware store and avoid future disputes over driveways and access. "There’s 13 lots in that block. Seven of the lots already do not meet the requirements," Terry said, arguing rezoning would make the block’s use clearer and protect existing low-income rentals.

Ed (speaker 10), chair of the Planning and Zoning Commission, summarized the commission’s history on the matter, noting a prior split decision and the limits of variances as entitlements. "Rezoning is not available to just anyone," Ed said, explaining the commission’s prior rationale. After council members discussed potential impacts on nearby residential uses and the town’s general plan, a motion to approve the zoning change carried on a voice vote.

The council’s action authorizes staff to update zoning maps and notify property owners of the reclassification; any future development proposals will follow the town’s permitting and conditional-use processes.
