Tomball council unanimously approves right-of-way abandonment, ETJ release and launches annexation process

The Tomball City Council on May 4 approved several land-use and infrastructure items, including an ordinance abandoning an unapproved street right-of-way, a resolution to release property from the city's extraterritorial jurisdiction (ETJ) at the owner's request, and a resolution initiating annexation steps for a proposed commercial development.
On the second reading, council adopted Ordinance 2026-608, which abandons an unapproved street right-of-way associated with Tim Littlefield LLC. Planning staff recommended approval; the council voted to adopt the ordinance and the recorded outcome was "motion carries 5-0."
Council then considered Resolution 2026-23, prompted by an application from property owner Michelle Beauvais to be released from the city's ETJ. Beauvais addressed council in person, saying she was surprised to learn her farm was mapped in the ETJ and that portions of her property were being considered for medium-income housing. Staff explained the resolution formally documents the owner's request and expedites the statutory release process (otherwise the ETJ release would occur by law after a statutory period). Council adopted the resolution 5-0.
Staff also introduced Resolution 2026-18, a step to annex roughly 14.0934 acres to facilitate a commercial project identified as the Shops at Willow Creek (two tracts, ~8 and ~6 acres). Staff said some right-of-way along Tellview Road requires coordination with TxDOT and that public hearings and statutory steps will follow. Council approved the resolution of intent to commence annexation steps on a unanimous vote.
Other council actions on infrastructure and finance included authorizing sale of four older city vehicles to Montgomery Independent School District (four vehicles at $3,000 each), approval to appoint the city manager as the authorized representative for a FEMA BRIC grant for South Persimmon and Timken street improvements (Resolution 2026-19), and an amendment to TEDC contributions increasing the annual Southside Sewer Treatment Plant payment by $500,000 (Resolution 2026-21). Each motion was approved 5-0.
Votes were recorded as unanimous where noted; the annexation process and ETJ changes will move forward to the public-notice and hearing stages as required by state law.
