Staff said the change could be more economical and visually preferable if the interconnection is authorized.
Other clarifications: Council asked staff to confirm the agreement’s consistency with the original settlement requirements, and staff explained the building‑height language (single‑story appearances from Highway 91 achieved by walkout basement treatments) and park acreage (staff confirmed approximately 6.81 acres excluding the retention pond). Councilmember Anderson recused himself from the item and did not participate in the vote.
Outcome: The council moved, seconded and approved the development agreement as amended. Staff will incorporate the final language and proceed with the conditional process (Planning Commission preliminary plan review and other follow‑ups) required before final subdivision approvals.
