Ivins moves Parks & Trails amendment to public hearing after acreage, fee changes

Ivins city staff on Dec. 4 presented a first amendment to the May 2023 Parks and Trails Master Plan that updates project acreage and clarifies how park impact fees apply to certain resort-commercial residential units. The council voted to send the amendment to public hearing at a future meeting.
Parks staff reported that Fitness Way Park (proposed) grew from the previously estimated 4.5 acres to 6.81 acres after a recent land purchase; staff said they want to use impact-fee funds to cover land acquisition and to phase design and construction, with a projected construction start around 2029. "We wanted to amend it so that we could use 100% of the impact fee funds," the parks presenter said.
The amendment also clarifies the city's treatment of residential-type units built inside resort-commercial zones. Staff and council discussed whether short‑term rental units or lock‑offs that function like residences should be assessed park impact fees; staff said the change would allow the city to charge impact fees where a unit effectively adds residential demand on parks and trails.
City legal staff explained that impact fees are intended to pay for system‑wide public improvements and are legally distinct from project amenities developers might provide; council members discussed how to avoid "double counting" where a private development supplies its own amenities.
The council directed staff to place the amendment on the next agenda for a public hearing so residents may weigh in.
