Ivins council debates clause in AMI grant agreement; motion made to approve with amendment

Councilors on Nov. 20 evaluated a state funding agreement and Conservancy District contribution to install an advanced metering infrastructure (AMI) cellular system for Ivins’ water meters.

Staff said the selected system would use cellular endpoints mounted in meter boxes (not Wi‑Fi), with lithium batteries rated for about 20 years. The city has secured a grant and a commitment from the Conservancy District that together would provide roughly $600,000 toward the project; Black Desert Resort helped with the grant application and has an anticipated reimbursement arrangement for improvements it previously installed.

Council members sought a protective clause to make explicit that reimbursements and project costs match the terms of the award and that the city’s use of funds would not trigger an audit clawback if the state determined funds were used differently than described. One council member summarized the risk: an auditor could demand repayment if the contract language does not specifically reflect which party paid for what improvements.

A motion was made on the floor to approve the state funding agreement for the AMI installation with the additional clause clarifying reimbursements to the private partner; the motion was seconded and councilors discussed final wording before proceeding to finalize the agreement.

What happens next: staff will finalize contract language to include the requested clause about reimbursements and audit protection and bring the revised agreement back to the council for execution or final vote.
