Planner Connor LaVelle told the Athens County Board of Commissioners on Nov. 12 that a property on Della Drive is out of compliance with county floodplain rules and must obtain permits from the Ohio EPA and the County Engineer's Office.
The board voted to post a formal 30-day notice requiring the owner to secure the necessary permits and to refer the case to the Prosecutor's Office if the owner does not comply within that period; the minutes record the violation level as a misdemeanor. LaVelle said the deadline was reduced from an initially suggested 60 days to 30 days to encourage prompt remediation.
LaVelle recommended the referral after describing outstanding compliance steps and told the board the posted notice will explicitly state that "failure to comply within 30 days will result in referral to the Prosecutor." The board approved the 30-day notice and referral plan by roll call (Eliason, Chmiel, Adkins all yea).
