Hartselle council unanimously adopts four ordinances, accepts Cain Park infrastructure

The Hartselle City Council on April 14 approved a slate of land‑use measures and infrastructure acceptances affecting future development in and around Cain Park.
Development Director Jeremy Griffith told the Council that Ordinance 1643 would amend the city’s zoning code to prohibit replacement of non‑conforming mobile homes that have been removed from the property or re‑establishing units that are damaged beyond 50 percent of their ad valorem tax value, with an exception for grandfathered mobile home parks. Planning Commission recommended approval. After a public hearing with no speakers, Council Member Mike Swafford moved to adopt Ordinance 1643 and Council Member Virginia Alexander seconded; the motion carried by unanimous voice vote.
Mr. Griffith also presented Ordinance 1648 to rezone two acres on Foote Road from AG‑1 to R‑1 to allow subdivision into two one‑acre lots. The request conforms to the city’s comprehensive plan and the Planning Commission recommended approval; Council Member Austin Baker moved for adoption, Council Member Mike Swafford seconded, and the Council approved the measure unanimously.
The Council considered two items tied to the Cain Park subdivision. Ordinance 1649 will annex 56 acres on East Byrd Road for remaining phases of Cain Park; Council President Dr. Charles Gill asked questions about road improvements that Mr. Griffith and City Attorney Larry Madison answered. After a public hearing with no comments, Council Member Sherry Yeager moved to adopt the annexation ordinance and Council Member Mike Swafford seconded; the motion passed by unanimous voice vote. The annexed acreage will be zoned R‑5 under Ordinance 1650, a zoning designation described by Mr. Griffith as single‑family patio homes and consistent with the approved R‑5 master layout for Cain Park; Council Member Yeager moved to adopt Ordinance 1650, Council Member Virginia Alexander seconded, and the measure passed unanimously.
The Council then approved Resolution 26‑0414 and Resolution 26‑0414A to accept public maintenance of infrastructure built for Cain Park Phases 1A and 1B. Mr. Griffith said the City Engineer inspected the streets, drainage and sidewalks and the developer provided the required 12‑month warranty bond; both resolutions passed by unanimous voice votes.
Each of these items carried the Planning Commission’s favorable recommendation and all were adopted without recorded dissent. The Council’s actions formally permit subdivision, annexation and public maintenance of completed infrastructure for the next phases of Cain Park.
