The North Providence Town Council on May 5 approved a petition to abandon about 3,200 square feet of Tyler Street so Marconi Street LLC can relocate buildings and preserve a buffer for the Marconi Street condominium project.
Attorney Waring, representing Marconi Street LLC, told the council the change is part of a settlement with neighbors that reduced the project's density and altered building placement. "As part of the settlement, we've agreed to purchase a portion of Tyler Street...so that we could relocate some of the buildings and keep a buffer in front of Marconi Street," Waring said.
Council President Aurielo noted the planning board had recommended approval. Waring said final legal steps remain: once the council acts, the company will file a dismissal stipulation in Superior Court. Councilman Bacalas announced a recusal before the vote; the council approved the abandonment after a motion and second.
The action does not itself change site plan approvals or other permitting; Attorney Waring told the council the planning board and town planning processes already recommended the change. The developer previously purchased an adjacent abandoned portion of Tyler Street, the attorney said.
The council’s vote means the town will process the abandonment and the parties expect to record the court dismissal after the abandonment is finalized. No additional conditions or amendments to the council’s motion were recorded at the meeting.
