Staff told the commission approving these extensions will maintain compliance with the Metro Act and allow McLeod USA to continue operation and maintenance of its telecommunications facilities in the city's right-of-way; all other terms and conditions remain unchanged and the city attorney has reviewed the extension agreements.
Commissioners probed implementation and oversight, asking whether route maps and as-built records are submitted and how the city coordinates with utilities during major construction. Staff said route maps and as-built records are required by the permit (section references were cited) and that the city requests as-built records upon request and coordinates with utility companies during construction projects such as major street work.
Commissioners also discussed that Metro Act opt-in creates limited ability for the city to deny applications without exposure to litigation; staff noted permit fees are collected by the state and distributed back to municipalities. The motion to approve the extensions passed on a roll call.
