The sequence began when Dallin and Talynn Willis moved forward with excavation and later discovered the foundation placement extended into required setbacks. Dallin said they halted construction and presented revised plans after consulting the building inspector; he also read a letter from an ombuds and told the council the family had relied on town‑official guidance in placing the foundation. Planning & Zoning denied the modified‑setback request at its March 25 meeting and recommended against the change.
Council entered a closed executive session to discuss possible litigation and then reconvened in open session. Council Member Burdette Weston moved to approve a letter allowing a reduced setback of 20 feet for one side of the house for this single case; Council Member Kris Hodges seconded the motion. The motion passed unanimously.
Mayor Brandon Willis said code updates remain part of the broader solution and signaled that the council will continue reviewing permit processes and P&Z’s role in future work sessions.
The action was recorded as a case‑specific accommodation; council did not adopt a permanent waiver or change to the town code during the April 1 meeting.
