The committee moved, seconded and passed a motion to go into closed session under § 2.2-3711(A)(16) of the Code of Virginia to consider medical and mental health records relevant to the reinstatement application; Weaver, Lee and Smith were authorized to attend because their presence was deemed necessary to the deliberations.
After the closed session the committee certified that it had discussed only matters lawfully exempted from open-meeting requirements under Virginia's Freedom of Information Act. The committee later convened a second closed meeting under § 2.2-3711(A)(27) to deliberate and reach a decision in Dr. Nguyen's case, again authorizing staff attendance for deliberations.
Erin T. Weaver reported that the committee had granted Dr. Nguyen's reinstatement to practice dentistry in the Commonwealth of Virginia contingent upon certain terms and conditions. Dr. Bruce R.
