Madison County officials told the board May 4 that a chancery judge ruled the 2020 tax sale at issue had been held improperly and issued an order voiding the sale.
County counsel reported the county brought suit against the chancery clerk's office alleging failure to follow statutory notice requirements for the tax sale. "We filed suit against the Madison County Chancellor Clerk's Office for failure to abide by the statutory process to provide notice for tax sales," counsel said at the meeting. The county reported the hearing occurred before the chancery judge, and the judge ruled in the board’s favor, voiding the tax sale.
The county counsel said the judge denied other claims in the case, including requests for $1,500 in legal fees and two years of reimbursed property taxes. After the meeting, county counsel said reimbursement questions would be handled with the tax collector and the chancery clerk’s office, not the board of supervisors.
The board moved and unanimously acknowledged/authenticated the judge’s order. County counsel thanked staff in the chancery clerk's and tax offices for cooperating during the process.
