Melbourne Beach planning board tables 6th Avenue addition over missing drainage plan; approves two nearby additions

At its May 5, 2006 meeting, the Town of Melbourne Beach Planning & Zoning board tabled review of a proposed addition at 22222 6th Avenue after members found late or incomplete submittals and unresolved questions about setback encroachment.
Board members said the packet for the 22222 application did not include a stamped, current survey or an adequate drainage plan and that the second-floor design appears to project into the 15-foot setback. “The second floor goes out an extra 5 foot 6 inches, which should be 15 foot into the…15-foot setback,” said the building assistant, who reviewed measurements from the survey and plans. The applicant said the projection is cantilevered and does not touch the ground; he asked the board to consider that distinction, but members said the town’s code and practice prevent increasing nonconformity without a variance or clearer engineering guidance.
After discussion, a member moved to table the application until the town received: the most recent stamped survey, updated plans, a drainage plan, and a determination from the building official or engineer about how far a second story may cantilever into the setback. The motion passed by voice vote with board members in attendance voting aye.
Separately, the board approved a proposal at 218 6th Avenue for a master-suite addition but made the approval contingent on the town engineer’s confirmation that the stormwater/drainage measures meet the town’s requirements. Contractor Dave Silver of Elevation Contractors told the board a preliminary stormwater plan had been submitted late and that his engineer sought clarification on whether the addition must be sized for an eight-inch (100-year) storm or only for the incremental runoff from the addition. The board specified that the permit cannot be issued until the drainage requirement is fulfilled and the town engineer signs off; the voice vote to approve the plan on that condition carried.
The board also reviewed and unanimously approved the application for 200 Shannon Avenue after members said it met the code standards.
What happens next Staff will notify the applicant for 22222 6th Avenue of the required resubmittal items and seek an engineering/building-code clarification about cantilevered projections and setback calculations. The 218 6th Avenue permit will proceed only after the town engineer confirms the drainage plan meets local requirements.
