At the Jan. 13 meeting the Planning Commission debated a request to transition two Pasadena bonds from performance to maintenance status and ultimately voted to keep the performance bonds in place for an additional 90 days.
Staff explained the request would transition a $651,541 performance bond and a $140,000 maintenance bond; staff clarified the town would continue to hold roughly $791,541 in security. A commissioner raised a concern that landscaping remained incomplete and cited an inspection that identified 15 missing trees, 29 dead trees and eight trees in poor health, a total of 52 trees that still needed attention. That commissioner said this pattern had appeared in other subdivisions and cautioned against prematurely moving to maintenance status.
Commissioners discussed whether ‘substantial completion’ should be clarified in the zoning ordinance and whether the town should require more performance completion before allowing transitions to maintenance. One commissioner proposed extending the performance bonds for 90 days to allow planting season (March–April) for replacements; that amendment passed and the amended motion to keep the performance bonds in place through April 6, 2026 was approved by voice vote.
Staff said the town will continue periodic inspections during the maintenance period and retains the right to call the bond or require an extension if required work is not completed within the next year.
