A public commenter, Green, reviewed the letter and strongly disputed parts of the attorney's analysis, saying it contained "false facts" and arguing the special-tax (Measure L) proceeds are limited to maintaining the authority's current level of service.
Green asked whether funding rooftop solar and batteries would be an allowable use of the special-tax money, saying the library currently does not have batteries or a standby generator and that installing solar and batteries would be an expansion rather than maintenance. "I do not see how NCLA money can appropriately be used with solar on the roof or batteries," Green said.
Several board members responded that outside counsel's opinion is advisory and that the board is the deciding body on whether a proposed expenditure fits the measure's terms. One director said the board can decide whether a proposed change is an appropriate use of funds and noted that the attorney's view does not bind the board to a particular outcome.
No action was taken. Board members asked staff to place the matter on a future agenda so the public can participate in further discussion before any spending decision is made.
