County staff explained that Milford Solar 1 missed the deadline to request the 2025 refund but submitted a written request within the contract’s remedy window; staff said attorneys submitted the written request and the county determined the company met the remedy clause requirements.
Staff told the board the amount at issue was $997,389.44 and commissioners discussed the timing and the fact that, although the agreement was executed earlier, repayment schedules extend to 2029. A motion to authorize the refund was moved, seconded and approved by voice vote.
Commissioners expressed sympathy for the administrative error but approved the refund under the participation agreement’s remedy provision.
