Board keeps record open on North Amityville pool application, asks for revised plans and DEC clearance

The Town of Babylon Zoning Board of Appeals heard application 2662, filed in the name of Dawn Ronco, for an in‑ground pool and associated patio in North Amityville. John Ruko (Speaker 3), who presented the application for the record, said the proposal is for a built‑in pool and accompanying outdoor work.
Board staff noted a planning division memo (04/28/2026) and an environmental control memo (05/06/2026) were in the record and told the applicant that a construction activity agreement would likely be required under local stormwater management rules. “You would need a construction activity agreement would be required pursuant to stormwater management,” staff said.
A committee member (Speaker 7) reviewed impervious coverage calculations and told the applicant the property is currently at about 51.7% lot coverage and that the board would seek revised plans showing reduced impervious surface to roughly 40% (leaving about 10% pervious). The committee member asked the applicant to submit new plans via the online portal showing where concrete will be removed and replaced with pavers or pervious material.
The applicant acknowledged the DEC permit process for wetland work is still pending and said they will await state approval before beginning construction. The board closed public comment for this item, reserved decision and kept the record open pending submission of revised plans and confirmation of required permits.
Next steps: applicant to file revised plans showing reduction in impervious coverage and to provide updates on the New York State DEC permit; the board will issue a decision after reviewing the supplemental materials.
