TAC hears municipalities consider policies for maintenance on legal trails after Tunbridge decision

Bryan Davis (CCRPC) told the TAC that the Vermont Supreme Court decision in the Tunbridge case and subsequent Act 66 have prompted municipalities to consider creating documents that clarify municipal policy and standard operating procedures for maintenance on legal trails. Davis said such documents should be developed in coordination with municipal attorneys.
Bob Henneberger noted the legislature closed the loophole referenced in the Tunbridge case. Josh Arneson (Richmond) said the town attempts to be proactive but does not maintain private driveway accesses. TAC members were invited to bring additional information to a future meeting for further discussion.
