Council rejects censure; mayor and attorneys call for due process as outside 'interim' report circulates

Mayor Joseph and his attorney, Luis Suarez, argued the report was explicitly labelled an interim report that repeatedly states "possible" or "alleged" findings and expressly calls for "further investigation." Suarez told commissioners that the mayor has not been afforded the process to respond and warned the body of legal risk should it act on unfinished material.
Commissioners debated several procedural questions: whether the commission should await outcomes of the State Attorney’s Office or the Florida Commission on Ethics, whether transcripts or audio recordings of witness interviews should be made available to the mayor and the public, and whether earlier censures of former commissioners required retroactive process changes. Several commissioners said they wanted to stand with city employees who reported being mistreated; others pressed for due process and cautioned against making findings on interim material.
A roll call to censure the mayor did not succeed. Commissioners then agreed to return the topic for a more fulsome discussion at a future meeting and directed staff to coordinate availability of investigative records with the appropriate investigative bodies where legally permitted.
