County staff briefed commissioners on the Department of Water Resources solicitation for the Fugleburg drainage application and recommended the county submit clarifying comments. The presenter pointed out that attachment B of the application suggests the culvert would be lowered two feet while attachment C shows the culvert remaining at the existing elevation, creating ambiguity.
The staff speaker warned this uncertainty affects road integrity and downstream impacts and urged the commission to seek clarification from the state, including who would bear the cost and permitting responsibility if a culvert lowering is intended. "There's actually conflicting information in the application," the staff member said. Commissioners asked staff to draft a comment letter outlining two scenarios and to circulate the draft for review; the commission indicated the chair should sign the final letter.
Next steps: Staff will draft the letter, circulate for commissioner review, and submit under the chair's signature once approved.
