Fabian D’Arlo, assistant director of recreation and cultural services, summarized the agreement’s headline terms: “This initial contract is proposed for 4 years, so it would run through 2030. There’s one additional four‑year renewal option” and the vendor would provide an equipment advance of $19,269 and a $5,000 security deposit. The proposal sets a base rent of $1,800 per month with a four‑month rent waiver to help the business start up and a minimum of 40 hours of operation per week.
A representative of Dope Venture Partners described the vendor’s menu and signature item: “Our Dote Burger is basically it’s a vibe. It’s our our most popular signature burger. It has vegan bacon… It’s fun. It’s family oriented.” The vendor said the concession would offer both plant‑based and traditional options, beverages and cold‑weather morning items.
Commission discussion focused on the vendor name, the structure of the lease and whether the city should receive a revenue share rather than a flat monthly rent. Procurement said staff reviewed options and recommended the fixed rent structure to simplify budgeting and reconciliation. Commissioner Cruz urged a revenue share or an annual CPI‑type escalator to protect city revenue; commissioners and staff negotiated an amendment providing a 5% annual rent increase starting in year two.
With the amendment in place the commission approved the motion. The contract will be executed as the Boynton Beach concession (DV at the Beach/Dope Vegan) with the added annual escalator language and the standard city termination clauses.
Next steps: staff will finalize contract documents and move forward with onboarding and vendor move‑in procedures; the commission directed staff to continue to monitor branding, sustainability practices (recyclable utensils, etc.) and options for the city to track revenue performance.
