DeBary council clears first reading to extend timelines, options for Mosaic Main Street project

Mayor Chisholm opened a quasi-judicial public hearing and the City Attorney read Ordinance 01-2026, proposing amendments to the development and purchase‑and‑sale agreements between the City of DeBary and Mosaic at DeBary LLC for the Main Street DeBary mixed‑use project.
Stephen Babb, Growth Management Director, told the council the amendment combines two previously separate phases into a single phase and "extends the completion date of those two phases to December 30th, 2030." He said the amendment would also move the closing deadline for the city‑owned 5.62‑acre parcel to "on or before December 18th, 2026," and would extend the developer's option and right of first refusal on the locally known "Moose" property to March 31, 2033.
Council member Pappalardo pressed staff on protections if Mosaic transfers the project to a secondary buyer, asking, "What can you describe the kind of protections we have should the property be transferred to a secondary buyer?" Staff replied that any change to the site plan would require an amendment to the development agreement and return to council for approval, and that the Main Street regulations remain enforceable.
Council members also raised financial concerns about the city carrying property that is not yet developed. Staff said Mosaic has been active in monthly coordination with city staff and that the purchase price to acquire the 5.62 acres was roughly $1.8 million, adding that future extensions would prompt renegotiation of price and terms.
After discussion, Council member Stevenson moved to approve the first reading of Ordinance 01-2026; Vice Mayor Butland seconded. The motion passed unanimously with recorded "yes" votes from Vice Mayor Butland, Council members Pappalardo, Sell, Stevenson and Mayor Chisholm.
Because this was a first reading, the ordinance will be scheduled for a second (adoption) reading at the next available council meeting; staff said it will be placed on the April meeting agenda for final action if no substantive changes are required by the council.
