Matt Flynn, attorney for the applicant 789 Hamilton LLC, told the board the project — previously approved on June 21, 2023 as a three-story building with about 2,300 square feet of retail and 25 apartment units — needs additional time to work through comments from the county planning board. "We are requesting our second extension under the municipal land use law for a one-year extension of time through June 21st, 2027," Flynn said.
The extension was requested under the Municipal Land Use Law; Flynn said the team received county feedback in early March and expected to resubmit revised materials within days. Chairman Orsini moved to approve the extension, and the motion passed on a roll call. Recorded votes in favor were Councilman Embarson, Robert Lort, Jennifer Ragnau, Mahir Rafi, Charles Brown, Robert Thomas, Sammy Siobhan and Chairman Orsini.
The board framed the vote as an administrative extension to allow coordination with the county and made approval conditional on satisfying all standard staff and outside-agency requirements. No member of the public spoke about this item during the meeting.
Next steps for the applicant include responding to county comments and proceeding with any outstanding agency reviews before the extended approval expires.
