Berkley council approves first readings to trim sidewalk bond term and tidy code provisions

Berkley — The Berkley City Council on March 16 approved a set of first readings that revise multiple sections of the city code to reflect recent procedural changes and engineering recommendations.
Staff told the council that current standards require property owners to post a five‑year bond when replacing sidewalk slabs, but consultants (Spalding DeDecker) and DPW experience indicate most early failures would occur within the first year. The proposed ordinance reduces the bond prerequisite term to one year.
At the same time, staff presented proposed cleanups to the nuisance ordinance (chapter 78). The amendments remove references to noise nuisances because noise will be regulated under the newly adopted chapter 74 standards; false alarms were also removed as a nuisance at the request of the public safety department.
Council also approved a first reading to amend chapter 2 (administration) to clarify authority to issue appearance tickets tied to the municipal civil infraction framework. Staff said these items are part of a package of code updates following the city’s recent ordinance reorganization.
Each item passed on a roll-call vote. Councilmembers asked clarifying questions about ordinance references and thanked staff for the work to align code language.
