Berkley — On March 16 the Berkley City Council approved first readings for four city-initiated rezoning corrections that change small-lot single‑family parcels from R‑1AB to R‑1CD to match existing lot dimensions and the city’s March 2025 zoning update.
City staff said the comprehensive rezoning completed in March 2025 rezoned every parcel and staff later identified several properties that were assigned the wrong district. The corrections — PRZ‑01‑26 (2429 Sunnyknoll), PRZ‑02‑26 (2431 Sunnyknoll), PRZ‑03‑26 (2435 Sunnyvale) and PRZ‑04‑26 (2437 Franklin Road) — were posted per state law, heard by the planning commission, and recommended for approval on Feb. 24.
Staff emphasized the practical consequences for homeowners: if a property is mis-zoned and later suffers major damage, it could become nonconforming and face limits on rebuilding. "We don't want to create a situation for them where they have become a non‑conforming property and now have to seek variances," a staff presenter said.
Councilmembers thanked staff for the attention to detail and the outreach to affected property owners. Each rezoning passed on its first reading by roll-call vote.
Because these are map corrections arising from a prior comprehensive rezoning, the items proceeded as first readings with findings per section 18.04 of the zoning ordinance.
