The Brevard County Board of County Commissioners voted unanimously to continue the Merit Island Bidco rezoning hearing and to waive the county’s 180‑day statutory review deadline. The board set the matter for the May 7 zoning meeting at 5:00 p.m.
Staff had told the board that, absent a waiver from the applicant, the six‑month timeline for acting on the application would expire at midday and thus required the board to take action by May 7. Commissioners and staff discussed that if the applicant makes a “substantial amendment” — for example, by adding adjoining property or materially changing the proposal — the application may be treated as a new filing and would restart the public‑notice and review process.
A motion to continue the item was offered and seconded; Commissioner Atkinson seconded the motion and the vote was recorded as carrying unanimously. Staff and the chair told audience members that because the matter is quasi‑judicial, comments made outside the formal public hearing for that item will not be part of the official record and could be problematic in any future appeal of a board decision. Staff also said it would distribute notice and planning‑board dates to interested attendees who provide contact information.
The continuance preserves the applicant’s opportunity to revise the proposal or to supply any requested amendments before the board hears the matter again. The board did not take any final action on rezoning or conditions for the property at tonight’s meeting.
