Lancaster County board approves variance to allow Kennedy carport on Corrotoman Drive

The Lancaster County board approved a variance allowing Michael and Pamela Kennedy to build an 18-by-30-foot metal carport that would sit 42 feet from the center line of Corrotoman Drive, a 33-foot encroachment of the 75-foot front setback required by the county code.
The variance was described by staff as a response to constraints created by the Corrotoman by the Bay subdivision’s small, pre-zoning lots and by on-site septic and drain-field locations. Staff noted prior similar variances in the same subdivision and said adjoining property owners were notified and that no written public comments had been received before the hearing.
Applicant Michael Kennedy joined the hearing online and told the board that the corner-lot layout, septic tank distribution box and drain field limit where an 18-foot-wide carport can be sited without driving over septic infrastructure. “This looked like to me the best place from an aesthetics and usability point of view,” Kennedy said. A board member asked whether the carport could be moved closer to an existing shed and driveway; Kennedy replied the distribution box and required setbacks make that infeasible.
After closing the public portion, a board member framed the request in the context of the subdivision’s pre-zoning development and a history of granting reasonable variances there, and a motion to approve the variance passed by voice vote (‘Aye’). The staff report and applicant materials in the record show the property as original lots 606 and 607 (tax map 20D-2-606 and 20D-2-607), addressed in records as 33 Land's End West on Virginia State Highway 1070 (Corrotoman Drive).
Staff cited the relevant local provisions as Article 5-3 (setback regulations) and the corner-lot rules in Article 5-7 of the Lancaster County land development code during the presentation; the approved relief reduces the front setback from the 75-foot requirement to the requested 42-foot distance in this instance.
The hearing record indicates the board closed the matter and moved on to other business; no conditions beyond the approved site plan were stated on the record.
