Murfreesboro — The City Council approved a package of right-of-way acquisitions and related authorizations for the Cherry Lane Phase Two project, staff said.
Mr. Griffin presented the proposal and said the project requires right-of-way, drainage, slope and temporary construction easements from 39 separate parcels; six parcels are anticipated to be "whole takes." He told the council staff received a proposal from JMT for $478,830, which includes a 10% contingency for additional services.
Staff recommended offering landowners an additional 10% above appraised values to avoid condemnation and, if agreements cannot be reached, proceeding with condemnation and depositing the appraised values in court. The council moved, seconded and approved the staff recommendation on a roll call vote.
Why it matters: The action clears the final phase of corridor work for Cherry Lane and allows staff to begin acquisition negotiations and, if necessary, initiate condemnation to keep the schedule for right-of-way acquisition. The funding source and any required budget adjustments were not specified during the presentation.
What comes next: Staff will proceed with appraisals and negotiations; if offers do not produce agreements, the council authorized the use of condemnation procedures with court deposit of appraised values.
