Council approves fee-in-lieu agreement for 'project 2493' after minor wording changes; vote 5–1

Chester County Council approved, on third reading, ordinance 2026-02 to authorize a fee-in-lieu agreement with an entity identified as "project 2493," designating certain county property as part of a multi-county industrial park and providing for credits and related agreements.
County counsel/advisor John Marshall told council the changes received from the developer after the packet deadline were not substantive: "only one change... the effect of those changes was essentially just to change uh the amount of fees that the developer was willing to pay. It doesn't actually change the total amount." Council members asked whether participating in a multi-county park exposed Chester County to liability for projects physically located in another county; counsel explained that the "driving county" makes decisions and Chester typically receives a 1% share and does not assume decision-making authority or liability for projects wholly located in another county.
Following brief discussion the ordinance was moved and seconded and passed on third reading; the chair announced the motion passed "5 to one." No further amendments were recorded at the meeting.
Next steps: execute the fee agreement and related documents as authorized by the ordinance.
