Madison County commissioners on Nov. 24 approved a settlement-agreement framework with Wednesday Investments that would place specific conditions on a proposed development and restart the public review at the plan commission level.
County attorneys explained the board cannot bind its final vote until the normal public-hearing process is completed, but the approved settlement would obligate the applicant to dismiss a pending lawsuit if the board grants the conditional use with the negotiated conditions at the Dec. 29 hearing. The settlement thus recalibrates the process—returning to the plan commission level and adding conditions rather than a full restart. Officials said the conditions would be circulated to the public and could be included in mailed notices.
During the meeting, public commenters asked whether the settlement was being used to pressure 'yes' votes and requested that the county post the letter received from the applicant’s attorney and the proposed conditions online. County staff said the letter that preceded the suit is an open record and that the county would make documents available; they reiterated that the Dec. 29 meeting will be the public hearing where residents can comment and where the board will decide to approve or deny the conditional use. The board approved the settlement framework by motion and consent to proceed to the advertised hearing.
