Committee tables broad rules and charter amendments after solicitor review requested

Committee members on May 6 considered a broad set of proposed changes to council rules and several charter amendments affecting voting thresholds and procedures.

Councilors Panitch and Talheimer submitted a draft rewrite intended to clarify when legal form should be requested, committee procedure, and notice requirements. A substantive debate followed about whether legal form should always originate from the committee debate or whether some minor changes should be drafted in legal form before committee review. Councilor Linda Bacon and others cautioned against overloading the law department and argued the committee process should be the primary vehicle for debating substance before requesting legal form.

City Solicitor Mike Bissonnette advised that practices at the federal and state levels differ and that the committee should separate notice and suspension provisions to avoid unintended consequences, especially on retroactivity. On charter matters, the committee discussed proposed language that would change ordinance adoption thresholds (one proposal would restore a two‑thirds requirement; another would enshrine a simple‑majority norm). Councilors expressed philosophical disagreement about whether supermajorities better protect deliberation or whether simple majorities prevent deadlock.

After discussion, the committee voted to ask Solicitor Bissonnette to break the draft into clear parts, prepare redlines and legal advice, and return the matter to the next meeting for further committee consideration. The committee tabled the items pending that solicitor review.
