The Allegany County Ways & Means Committee on April 8 approved a resolution to accept the Opioid Six Remnant Defendants’ Settlement Agreement and authorized the chairman of the Board to execute required documents, including Exhibit G — the Combined Subdivision Participation and Release Form.
Assistant County Attorney Aaron Moore told the committee the deadline to approve the settlement is May 4, 2026. Moore said the terms of the Subdivision Participation and Release Form had been reviewed and approved by the County Attorney, but he did not provide the county’s share amount at the committee meeting. Legislator Healy asked whether an amount was known; Moore said he did not know but would try to provide additional information. County Treasurer Jenna Kelley said she can provide the Board with a report listing settlement payments the county has received so far.
The Six Remnant Defendants named in the request were Associated Pharmacies, Inc. (and American Associated Pharmacies), J.M. Smith Corporation, Morris and Dickson Co., LLC., Louisiana Wholesale Drug Company, Inc., North Carolina Mutual Wholesale Drug Company, Inc., and United Natural Foods, Inc. (and SuperValu). The assistant county attorney asked that the Board chairman be authorized to execute all documents necessary to receive settlement payments.
The committee approved forwarding a resolution for Board consideration and directed staff to prepare the resolution. No vote tallies were recorded in the minutes; the action is recorded as having been approved on a motion and carried.
Next steps: County Attorney’s office and staff will prepare the resolution for the full Board and the Treasurer will be asked to provide a report of settlement receipts to date ahead of the May 4 decision deadline.
