The Ashwaubenon Plan Commission on May 5 approved the final plat for Winding Creek Estates (Parcel VA-L333-2) with a set of staff‑recommended conditions that the developer must satisfy before final village and county acceptance.
Staff summarized the plat as an extension of Pagels Place with connections to Ponds Edge Court and a mix of single‑family lots, duplex areas, townhomes and a future apartment area, plus a stormwater pond adjacent to environmentally sensitive creek areas. The presenter told the commission that the PUD has a one‑year approval window and that staff is meeting the development team later in the week to finalize a development agreement.
Staff read the conditions into the record: approval by the Village Board of the PUD extension request; revise the recreational trail easement granted to the village to 20 feet; change a 10‑foot drainage easement to 12 feet on Lots 1–12; overlay the proposed pond and outlot 1 with a 12‑foot maintenance area and include the berm within the property line; prepare a detailed stormwater management report with calculations and an erosion control plan for village engineer review; confirm rear‑yard drainage for Lots 12–22 and Lots 28–46 and review the potential need for additional stormwater management facilities for specified lots; prepare engineering and construction documents for village engineer review; review sanitary sewer plans for the eastern part of the development and evaluate a potential 30‑foot easement and connection to a new interceptor sewer; indicate shoreland zone areas on the final plan; adopt a formal development agreement between the village and developer covering utilities, road construction, warranties and payment processes; and obtain final plat approval by the Brown County Planning Commission.
Staff also said the developer must pay $46,004.95 in park fees and that construction and delivery traffic shall not access the site via Ponds Edge Court. The presenter said staff is working with TC Energy to secure an additional trail easement above an existing 100‑foot pipeline easement to extend the Sand Acres Trail north to Arts Lane.
Developer representative Andrew Berger described the connector road to West Main as an ongoing conversation: “The update is, no progress yet… it appears that it will happen at some point. The timing is just, yet to be determined,” he said. Commissioners said the connector would relieve traffic pressures if constructed, and asked whether a right of first refusal existed for a homeowner who would block the connector; a developer representative said no right of first refusal exists.
Chris Atkinson moved to approve the final subdivision plat for Parcel VA‑L333‑2 subject to the staff conditions; the commission voted in favor and the motion carried. Final acceptance requires completion of the listed conditions, village development‑agreement approval and Brown County Planning Commission approval.
