Commission forwards recommendation of denial to city council for proposed 'Springs District' overlay

The Pleasant Grove Planning Commission on April 9 voted to forward a recommendation of denial to the city council for a proposed code-text amendment submitted by Julie Smith to create a Springs District overlay (an overlay to allow a cluster-style development adjustment on an existing planned development of roughly 20.6 acres called The Renaissance and Indian Springs).

Staff and the commission expressed concern that the overlay would conflict with an existing approved plan that designates portions of the property as perpetual open space and that permitting a carve-out could set a precedent for converting PUD open space into buildable lots. Director Cananos told commissioners staff had explored alternative channels but remained concerned about setting precedent even while sympathizing with the HOA’s situation.

The applicant and a homeowners association representative argued the HOA faces financial strain and that subdividing roughly 4–4.5 acres for sale would shore up reserves and avoid future financial burdens on mostly older owners. The HOA president said the association’s reserves are modest — he cited approximately $150,000 in reserves — and said many owners are older and would struggle with major assessments.

Staff recommended denial, citing the prior approved plan and concerns about an overlay that would effectively change PUD conditions for a specific project. After discussion, Commissioner Bridal moved that the planning commission forward a recommendation of denial to the city council for the proposed code text amendment (City Code section 10-13, adding Article G, Springs District overlay). The motion to forward a recommendation of denial passed.
