Commission recommends DOA for Pike Road site, ties sidewalk to future permits

The Zoning Commission recommended approval of a Development Order Amendment for a 1.91-acre industrial property on Pike Road that would remove an eight-foot concrete wall requirement while retaining other prior conditions, the commission decided during its regular meeting.

The applicant, identified only as the property owner’s representative, told commissioners the request is possible because adjacent parcels were rezoned and the uses are now compatible. The representative said the site’s prior approval allowed contract/wholesale gas uses that were abandoned before the current owner purchased the property, and that some conditions from that previous approval have continued to apply to the property.

Staff clarified that the property is operating without required building permits and that a condition of approval requires the owner to cease use until they obtain necessary permits for landscaping, conversion of the use, parking and paving. Staff said they support removing the concrete wall requirement in most locations but want to retain certain conditions on the south property line and keep the sidewalk trigger tied to issuance of a building permit.

Commissioner Cheri Pavlik asked for clarification on the sidewalk; the applicant replied that the requirement would be tied to the first building permit so that sidewalk installation occurs when a structure is built rather than immediately. Staff explained the timing is intended to avoid installing and then damaging a sidewalk during interim heavy use or truck traffic prior to construction.

A motion to recommend approval of Item 3A carried. The commission recorded no roll-call vote totals in the transcript; the motion was announced as “passes.”

The commission’s action is a recommendation to the Board of County Commissioners for those elements of the request that require subsequent county approval.
