Weld County continues show‑cause hearing for RM Heiner Construction to Oct. 7, 2026

The Weld County Board of County Commissioners voted April 1, 2026 to continue a show‑cause hearing for RM Heiner Construction Company to Oct. 7, 2026 at 10:00 a.m., after planning staff said the applicant is actively working on required land‑use steps.

Diana of the Department of Planning Services told the board staff has reviewed outstanding items related to the second amended use‑by‑special‑review permit (2MR19‑95‑1075) for open‑pit mining, materials processing and related operations. She said staff needs the right‑of‑way vacation and the vacation of a recorded exemption to be completed, then the land split and the required USR amendment and floodplain/drainage work can follow. "Staff would be definitely supportive of a continuance at this point because the applicant is working with staff," Diana said.

An applicant representative, who gave an address in Evans, told the board Diana had summarized the situation and added: "I don't have any comments. I think Diana summed it up pretty clearly." Commissioners discussed whether to dismiss the case or allow more time for compliance; several said the applicants had made progress but that a continuance would avoid setting a precedent for incomplete remediation.

Commissioner Kevin Ross moved to continue the matter; the board amended the motion to set the continued hearing for Oct. 7, 2026 at 10:00 a.m. The board approved the continuance. The hearing record lists the matter as PCSC23‑000011 and identifies the property and permit (2MR19‑95‑1075).
