County staff call for caution on proposal to assess $2,300 fee on large employers

She said no U.S. state currently has an exact analog; Maryland passed a similar measure that was later overturned in litigation.
Michael, speaking for the county health department, described uncertainty about how collected fees would be distributed. "The bill is a little nebulous on exactly how the funds go out the door," he said, noting the enterprise board would have broad discretion and the bill’s amendments included guardrails to steer dollars toward providers and impacted areas.
Commissioners pressed staff on legal risks (Taber/general-fund arguments), whether the fee could be scaled, and whether counties would receive direct benefits. Staff said benefits would likely be indirect — for example, higher provider reimbursement could reduce county human services caseloads — and recommended the board keep a monitor status and pursue outreach on potential amendments.
The board did not adopt a position at this meeting; staff were asked to continue research and report back when stakeholders surface concrete amendment language.
