Council approves Nelson subdivision construction agreement pending engineering approvals

The Lennox council voted to approve the city's standard subdivision construction agreement for the Nelson addition Tuesday, but the agreement will not be executed until the city engineer approves the developer's construction drawings.

Staff said the standard agreement — reviewed by the city attorney — lays out developer responsibilities for constructing streets, sewers and water mains, the process for city acceptance of improvements, warranty securities and bond requirements to protect the city if a developer leaves the project incomplete. The developer had requested several deviations to the standard language; staff said those requests were denied to preserve consistency with existing regulations.

"This is the same construction you have on any other development," one staffer said, adding that the agreement is intended to protect the city and ensure that construction drawings match built infrastructure. Staff also confirmed the agreement will include only the improvements for which the developer is responsible and that bonds and warranty provisions remain in place.

Council moved and seconded approval of the agreement conditioned on the city engineer's subsequent approval of engineering submittals; the motion carried. Next steps include the developer submitting engineering drawings and the city engineer reviewing them before the agreement is executed.
