Patrick Warner, planner with the planning and community development department, said the applicant (Amcar LLC, represented in the meeting by Jacob Heinwer) needs a utility extension because an NCDOT NC‑150 widening project impacted the site’s leach field and precluded relocating the leach field without town water. “Granting extension would allow for the relocation of the site’s leach field,” Warner said.
Warner summarized that the property is currently county general business conditional use and lies within the town’s tier‑2 growth area and can be served by water but not sewer. Staff recommended approval, finding the rezoning consistent with the town’s comprehensive plan and the site compatible with surrounding commercial uses.
Commissioner Tucker moved to approve the conditional rezoning (CZ‑20260), citing conformity with the town’s plan and logical utility extension; Commissioner West seconded and the motion passed on a voice vote. The board then approved the voluntary annexation and utility extension ordinance (AX‑2606) for the same site in a separate vote.
The approvals authorize the town to extend water service to the property; sewer is not currently available. Fire and police confirmed response coverage and code compliance identified no outstanding issues. Staff noted any required environmental reviews would be completed before utility work proceeded.
Next steps include finalizing annexation paperwork and executing subrecipient or utility‑extension agreements necessary to deliver water service to the parcel.
