Residents urge enforcement of easement rules and use of quasi‑judicial process

Nancy Nangeroni (7315 Guadalupe Trail) asked why the commission could not hold a quasi‑judicial hearing so that recommendations previously adopted in August could be "adopted and legitimized" rather than effectively discarded. "If y'all decided we'd be better off doing things this way, then we should go to the extra trouble of setting up a quasi‑judicial proceeding within which those recommendations could then be adopted in an official and lawful way," she said.
Vincent Sanchez (682 Rio Grande) raised a separate but related enforcement concern, saying staff had told him easement approval responsibility would fall to the Middle Rio Grande Conservancy District (MRGCD). "Not only is this false, but has been a stance wrongly held by the village for years," he said, and urged the village to uphold its own code to protect semi‑rural areas and irrigation easements.
How the commission responded Director Schultz told the commission that some of the questions about quasi‑judicial procedure would be addressed in the staff report and that the Board of Trustees could direct staff to initiate a new quasi‑judicial application if the commission desired. Commissioners acknowledged the public’s concerns and used the staff findings to recommend that the Board consider quasi‑judicial review for selected VC entitlements.
Next steps The concerns raised by commenters were recorded in the hearing record. The commission’s finding to the Board asks trustees to consider quasi‑judicial review of certain VC entitlements (including potential height reductions) should existing development agreements not proceed.
