Board of Adjustment grants final one-year extension for Main Street site

The Sayreville Board of Adjustment voted unanimously Feb. 25 to grant Insight Development Partners LLC a third and final one-year extension of its final approvals for the company’s Main Street site.

Tim Arch, an attorney for Insight Development Partners, told the board the applicant is entitled under municipal land use law and local ordinances to seek up to three one-year extensions and asked for the final extension after repeated lease negotiations fell through and because the property is now under a purchase-and-sale agreement that remains in due diligence. "We are asking that you give us that opportunity to make sure that we can get either a purchaser who can operate the site and start generating some tax income for the town, or alternatively to get a tenant in there," Arch said.

The board professional confirmed that outside-agency approvals — including water-company approvals and D permits referenced in the file — have been obtained, meaning the request is a discretionary extension rather than one compelled by a pending third-party signoff. The attorney told the board that, absent a tenant or a buyer ready to close, the owner faces substantial site-preparation costs and the risk of completing work on a vacant property.

After a brief board exchange, the chair opened the public portion; no members of the public spoke. A motion to approve the one-year extension carried on a roll-call vote with all listed members voting yes. The board said the decision will be memorialized at its next meeting.

The action allows the applicant additional time to finalize either a tenant lease or sale without having to restart approvals, but it is the final discretionary extension permitted under the approvals referenced by the applicant.
