The Village of Los Ranchos Board of Trustees voted on Oct. 21 to permit staff to open and review applications that were submitted while a Village Center (VC) moratorium is in effect, with explicit direction that staff should not issue final approvals until the moratorium's substantive rules are resolved.
Planning director Shana Schulz told trustees the proposed change "doesn't substantively change the moratorium. What it does allow the department to do is to start looking at applications that have come in within the moratorium area" so staff can exchange comments with applicants and reduce delay once the moratorium expires.
Trustees debated the trade-offs. Supporters said review would help applicants avoid months of delay, allow early identification of drainage or design issues and reduce duplication of effort when the moratorium lifts. Concerns centered on legal risk: if staff evaluates plans under existing code and trustees later adopt a different standard, an applicant could claim they relied on staff advice. Trustee Ranovich proposed an alternative of a narrow, square‑footage‑limited exception to allow a low‑risk, small expansion to proceed; other trustees favored allowing reviews but reserving final approvals for after the moratorium.
After discussion the trustees approved the staff proposal by roll call. The resolution keeps the moratorium in place, allows staff to begin plan review and emphasizes that approvals remain subject to future code changes and final trustee action.
The board recorded the vote as 4–0 in favor; trustees also asked staff to prepare supporting procedures and to provide clearer notice to applicants about the limited scope of any review.
