A Transportation Committee review of the House-passed transportation bill highlighted a provision that would put into statute the stateof Vermontability to require the posting or closure of municipally or state-owned bridges found deficient under National Bridge Inspection Standards.
Damian Leonard of the Office of Legislative Council told the panel the change reflects current practice and clarifies who may be responsible for actions and payments. The draft also creates a new $1,000 penalty for anyone who violates a posted restriction or a municipal/state closure. "If the municipality or the agency has posted or closed the bridge under this section and you violate that...they can issue you a fine of $1,000," Leonard said, adding the fine is assessed against the violator rather than the municipality.
Committee members asked whether other statutory weight/width/height penalties remain available and sought clarity on whether posting decisions and enforcement are the state's or municipalities' responsibilities. Leonard said the bill clarifies authority but that municipalities and the agency already operate under existing state and federal rules and that further technical questions would be handled by agency witnesses.
Next steps
The committee reserved further questions for agency testimony; no vote was taken during this session. Members signaled they will seek more detail on the implementation chain for posting, enforcement procedures, and how costs for necessary stabilization work will be assigned when postings or closures occur.
