Council agrees to modification of 2011 First Avenue court judgment, sets year-end fix for southeast corner and Oct. 1, 2026 review

The Vinton City Council on Monday approved a request to modify a court judgment for repairs at 2011 First Avenue, voting to allow the contractor additional time to finish a critical southeast corner by the end of the year and to reconvene Oct. 1, 2026 to review remaining work, including window replacement.
The motion to accept the second modification was made by Riley, seconded by Andrew, and carried on roll call. The contractor, Kevin, told the council he has “two items left to do” — a corner above a northwest doorway and a northwest doorway repair — and asked the council to allow him to finish a southeast corner this year and then resume other repairs next spring. Kevin described the remaining work as mostly minor masonry and tuckpointing and said window replacement remains the largest expense.
Council members discussed scope and timing and pressed on the windows’ cost and historical requirements. Kevin said he had met with Pella Windows and that replacement units would meet historic design standards but “they’re very expensive.” Several council members agreed that sealing the building and addressing the open southeast corner before winter was the priority.
Riley moved the modification and Andrew seconded; the council voted to approve allowing the contractor to complete the southeast corner by year-end and to return to the council on Oct. 1, 2026 to review progress and discuss window replacement. The council asked staff to have city attorney Doug draft the modification and submit it to the court.
Kevin said he would meet with staff after work was done so the council could inspect completed items. The council clarified that the modification was procedural — setting deadlines and reporting — and did not waive the requirement to complete the judgment work.
Next steps: staff will coordinate with the city attorney to draft the formal modification for court filing, and the council will review the project status on Oct. 1, 2026.
