Planning commission dismisses marijuana store permit after applicant no-show

The Kenai Planning and Zoning Commission dismissed a conditional use permit application for a proposed retail marijuana store at 6384 Kenai Spur Highway after the applicant did not appear at the March 11 meeting.

Director Butner told the commission that the applicant or a representative was not present and cited KMC 142.150D and the public hearing requirements in KMC 142.280. "At this time they are not here. I would ask that the commission table this so we can move to the next agenda item," Butner said, prompting commissioners to first table the matter by unanimous consent.

Later in the meeting the commission removed the item from the table and approved a motion to dismiss the application for PZ2026-05 because the applicant failed to appear. The commission approved the dismissal by unanimous consent. The chair clarified that dismissal under the code is not a denial and that the applicant may reapply with a new application fee and place the matter on a future agenda.

What happened: the commission opened the public hearing for Resolution PZ2026-05, then tabled it when the applicant was not present. After returning to the item later in the agenda, a commissioner moved to dismiss the application; the motion passed by unanimous consent of the commissioners present.

Why it matters: Dismissal removes the current application from consideration without a substantive decision on merits; the applicant may refile and present at a future hearing, restarting the review and public-notice process under city code.

Procedure and next steps: Commissioners who voted by unanimous consent indicated support of the procedural dismissal. According to comments made at the meeting, the applicant can immediately reapply; there is no automatic waiting period imposed by the commission when dismissal is for failure to appear.

The commission’s action was procedural; no vote on the underlying merits of the conditional use permit was taken.
