County attorney outlines court dates; administrators and commissioners flag fire risk and outreach

The Montezuma County attorney told the Board on March 24 that the status and setting conference for the Leaf Properties Dollar Store case is scheduled for May 21 at 2:00 p.m., with the court allotting 10 minutes per side for argument and indicating it will ask questions from the bench.
The attorney also described an unemployment appeal in which the hearing officer allowed a late filing after finding 'good cause' because the claimant said they did not receive a notice in the mail. The attorney called the result "beyond frustrating" and said the board should consider raising the issue with state legislators or exploring regulatory changes to the standards for good cause. Other board members expressed agreement with the frustration but offered no immediate directive.
On operations, County Administrator Miss Kim reported follow-up work on lodgers-tax distribution delays and said revenues are down; staff are working with state processes. She also noted coordination with Purple Wave on equipment ('yellow iron'), that Magellan Strategies will provide sample Q&A language (not ballot language), and that mag-chloride spray bars for road maintenance should be installed soon.
Commissioners highlighted outreach and wildfire risk. Commissioner Lindsay said landholders near Pleasant View thanked the county for cleanup work. Commissioner Copenhafer said all three commissioners attended the recent general assembly, described handling a pool of about 14 applications for a Southwest general manager position, and urged residents to attend a fire-prevention meeting that evening from 6:00 to 8:00 p.m. in the BOCC room; he also described plans for traveling evening town halls to increase public participation.
The meeting concluded without votes on the attorney’s recommendations; the next procedural step noted for the Leaf Properties matter is the May 21 hearing.
